Introduction
Welcome to the OSH Proterie EHS News App (the "App"), operated by OSH Proterie, a Nevada-based company ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the App, including any content, features, or services available through it, whether accessed via web or mobile app. By accessing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
These Terms incorporate our

1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement and that your use complies with all applicable laws.
2. Accounts and Registration

3. Subscription and Payments
Access to the App requires a subscription. Payment processing is handled through Stripe, and you agree to Stripe’s terms at
https://stripe.com/legal. We may update subscription terms with notice.
4. Email Notifications
By using the App, you consent to receive email notifications, including newsletters about new content. You may opt out of non-essential notifications via your account settings or by following unsubscribe instructions in emails, in compliance with applicable laws.
5. Licenses and Restrictions
We grant you a limited, non-exclusive, non-transferable license to access and use the App for personal or professional use, subject to these Terms. You may not:
- Copy, modify, or distribute any part of the App.
- Use the App for commercial purposes without our permission.
- Interfere with the App’s security or functionality.
- Violate any laws through your use.
If accessed via a mobile app, you must comply with the applicable app store’s terms (e.g., Apple’s App Store terms).
6. Content and Features
The App provides aggregated third-party content, including articles, videos (e.g., from YouTube), and other materials. We do not create or control this content and provide it for informational purposes only. You must comply with third-party terms (e.g., YouTube’s Terms of Service at
https://www.youtube.com/tos) when accessing such content.
Features such as liking or bookmarking are for personal use and do not imply endorsement. Links to external sources are provided as a convenience; we are not responsible for their content or availability.
7. Prohibited Conduct
You agree not to:
- Use the App to harass or harm others.
- Collect data without permission.
- Introduce viruses or harmful code.
- Use the App in ways that could damage it or infringe rights.
8. Intellectual Property
All content on the App is owned by us, our licensors, or third-party sources and protected by copyright, trademark, and other laws. You may not use our trademarks without permission.
9. Disclaimers
The App is provided "as is" without warranties. We do not guarantee accuracy, completeness, or availability. Content is for informational purposes only and does not constitute professional, legal, or regulatory advice. Use at your own risk.
We disclaim liability for third-party content, links, or services, including app store platforms or video providers.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our total liability is limited to the amount you paid us in the past 12 months, or $100 if no payment was made.
These limitations apply even if we were advised of potential damages.
11. Indemnification
You agree to indemnify us against claims arising from your violation of these Terms or your misuse of the App.
12. Termination
We may suspend or terminate your access at any time for any reason. Upon termination, your license ends.
13. Dispute Resolution
Disputes will first be addressed through informal negotiation. If unresolved, disputes will be settled by binding arbitration under American Arbitration Association (AAA) rules in Nevada, except for small claims court actions or injunctive relief related to intellectual property. You waive class actions and jury trials.
California users may exercise rights under the California Consumer Privacy Act (CCPA), as detailed in our Privacy Policy.
14. Governing Law
These Terms are governed by Nevada law, without regard to conflict of laws principles. Exclusive jurisdiction is in Nevada courts, subject to the arbitration clause.
15. Changes to Terms
We may update these Terms with notice via the App or email. Continued use constitutes acceptance.
16. Miscellaneous
If any provision is unenforceable, the rest remain in effect. These Terms are the entire agreement. No waiver unless in writing.
